This Acceptable Use Policy ("Policy") applies to your use of AllMyFlix and all Content on AllMyFlix and forms part of your agreement with us. This Policy outlines what is and is not permitted on AllMyFlix.

General Use

1. Use AllMyFlix only for your personal use. Do not sell, rent, transfer, or share your account or any Content obtained from your use of AllMyFlix with anyone else.
2. Use AllMyFlix in a lawful manner and for lawful purposes only.

Prohibited Content

Do not upload, post, display, or publish Content on AllMyFlix that:

1. Is illegal, fraudulent, defamatory, hateful, discriminatory, threatening, or harassing, or that encourages or promotes violence or any illegal activity.
2. Exploits, harms, or attempts to exploit or harm any individual under 18 years old by exposing them to inappropriate Content.
3. Includes or refers to:
1. Any individual under 18 years old.
2. Any other individual without written documentation confirming they are at least 18 years old and have given consent to use their name or images in the Content.
4. Promotes, advertises, or refers to:
1. Firearms, weapons, or any goods whose sale, possession, or use is subject to prohibitions or restrictions.
2. Drugs or drug paraphernalia.
3. Self-harm or suicide.
4. Incest, bestiality, violence, rape, lack of consent, hypnosis, intoxication, sexual assault, torture, sadomasochistic abuse, hardcore bondage, extreme fisting, genital mutilation, necrophilia, or excrement-related material.
5. "Revenge porn" or any sexually explicit material featuring individuals without their prior, express, and fully informed consent.
6. Escort services, sex trafficking, or prostitution.
5. Contains unsolicited sexual content or language that sexually objectifies another User in a non-consensual way, including "deepfakes."
6. Contains hate speech intended to vilify, humiliate, dehumanize, exclude, attack, threaten, or incite hatred, fear, or violence against a group or individual based on protected characteristics.
7. Contains or refers to anyone else's personal data or private/confidential information without their express written consent.
8. Features public nudity or sexual activities recorded or broadcast from places where public nudity is illegal or where members of the public are likely to see these activities.
9. Gives the impression it is endorsed by AllMyFlix or any other person/company without authorization.
10. Causes inconvenience, anxiety, or is likely to upset, embarrass, or seriously offend anyone else.
11. Is used to extract money or benefits in exchange for removal of the Content.
12. Involves or promotes third-party commercial activities without prior express consent.

Communication and Interaction

1. You may use text-based communication tools (e.g., comments, private messaging, public chat, forums).
2. Do not stalk, bully, abuse, harass, threaten, or intimidate anyone.
3. Do not engage in misleading or deceptive conduct.
4. Respect the intellectual property rights of Creators. Do not record, reproduce, share, or distribute their Content without authorization.
5. Do not impersonate AllMyFlix, our employees, another User, or any other person/company.

Technical and Security Standards

1. Do not provide false account registration information or use anyone else's information/content without permission.
2. Do not post spam, artificially increase views/interactions, or post inauthentic, repetitive, misleading, or low-quality Content.
3. Do not transmit pre-recorded audio/video material during live streams.
4. Do not use other media/methods to communicate anything that violates this Policy.
5. Do not introduce viruses, trojans, worms, or other malicious or technologically harmful material.
6. Do not decompile, disassemble, reverse engineer, or attempt to discover/derive the source code of AllMyFlix.
7. Do not use automated programs, tools, or processes to access AllMyFlix or to extract, scrape, collect, harvest, or gather Content or information.
8. Do not use AllMyFlix in a way that could adversely affect our systems or security or interfere with other Users' use of AllMyFlix.

Intellectual Property

1. Do not reproduce, print, distribute, download, modify, create derivative works of, publicly display, publicly perform, republish, store, or transmit any Content except as permitted under the Terms of Service.
2. Do not use AllMyFlix's name, logo, or any related/similar names, logos, product/service names, designs, or slogans without our prior written agreement.

Privacy and Approval Process

All content on the Service should not infer any type of privacy from viewing by AllMyFlix staff or administrators. This is required to moderate, monitor, or keep content in line with our Acceptable Use policies as set forth above. Only approved content creators are permitted to upload content to the Service. All submitted content undergoes a review process prior to being made available for sale or use. This review is conducted by AllMyFlix personnel to ensure compliance with our Policy and Content agreement.

Content Agreement

As a content provider, you agree to the following:

1. You will not engage in any activity that is illegal or otherwise violates the Standards.
2. You will obtain and keep on record written consent from all persons depicted in the content specific to the following areas:
   1. Consent to be depicted in the content.
   2. Consent to allow for the public distribution of the content and to upload the content to AllMyFlix.
   3. If you choose to make the content available for downloading by other users, consent to have the content downloaded.
3. You will verify the identity and age of all persons depicted in the content to ensure that all persons depicted are adults and will provide this information by creating a performer profile in Flix Studio for all co-performers appearing in the media if it is other than yourself.
4. To remain compliant with the Content Agreement, it is recommended to use AllMyFlix's consent and model release forms that are provided in the performer profiles section of the site.
5. We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, spammy, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
6. You agree to indemnify and hold harmless AllMyFlix and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.

Live Videos

Live videos may be viewed and/or interrupted by AllMyFlix personnel when a stream is reported or believed to contain content that is illegal, may be harmful personally or to others, or is not in compliance with our Policy and Content agreement.

Introduction

This document sets out our complaints policy. If you are a User of AllMyFlix, this Complaints Policy forms part of your agreement with us.

Interpretation

In this Complaints Policy, defined terms have the same meanings as in the Terms of Use for all Users. Additionally, "business days" refers to any day that is not a Saturday, Sunday, or public holiday in the USA.

Who Can Use This Complaints Policy?

This Complaints Policy is available to anyone, whether or not you are a User of AllMyFlix, to report any issues or complaints related to AllMyFlix.

How to Make a Complaint

If you have a complaint about AllMyFlix (including any complaint about Content appearing on AllMyFlix or the conduct of a User), please email your complaint using our complaints form. Include your name, address, contact details, a description of your complaint, and, if applicable, the URL for the Content in question.

Handling Complaints of Illegal or Non-Consensual Content

Upon receiving a complaint about illegal or non-consensual Content:

1. We will take appropriate steps to investigate your complaint promptly.
2. If we need further information or documents from you, we will contact you.
3. Your complaint will be thoroughly investigated and resolved within (7) business days
4. If we determine that the Content is unlawful or non-consensual, we will remove it immediately and notify you of our decision by email or other electronic message.
5. If we determine that the Content is not unlawful or non-consensual, we will notify you of our decision by email or other electronic message.
6. Any dispute regarding our determination that Content is non-consensual will be submitted to a neutral arbitration association at our expense.

Handling Complaints Related to Copyright Infringement

Complaints related to copyright infringement must be submitted in accordance with our DMCA Policy. We will respond to such complaints as set out in that policy.

Handling Other Complaints

For other complaints (including those related to breaches of our Acceptable Use Policy):

1. We will investigate your complaint within an appropriate timescale based on the nature of the complaint.
2. If we need further information or documents from you, we will contact you.
3. We will take appropriate actions to address the issue raised by your complaint. If the Content breaches our Acceptable Use Policy, we will act quickly to remove it.
4. We are not required to inform you of the outcome of your complaint.

Unjustified or Abusive Complaints

If you are a User of AllMyFlix, you warrant that you will not make any complaint under this Complaints Policy that is wholly unjustified, abusive, or made in bad faith. If we determine that you have breached this warranty, we may suspend or terminate your User account.

Your privacy is very important to us, which is why we've created a separate Privacy Policy to explain in detail how we collect, manage, process, secure, and store your private information. We value your safety so you should take precautions with interacting with people you do not know. Never respond to any type of request to send money, local or overseas via wire transfer, regardless of how urgent the person says the need is. Report this type of activity to us immediately.

If you decide to meet someone from this Service that you don't know, use your best judgment and take as much precaution as possible.

Never provide personal information directly to someone like banking or credit card info, social security number or home/work address you don't know or have not met. We provide a secure form on the site for media purchases and subscribing to creator channels.

AllMyFlix will never contact you requesting password or two-factor info. Never share this with anyone you do not know or trust.

We strive to exercise reasonable care and expertise in providing AllMyFlix to you. However, there are specific areas where our liability is limited:

1. Content Approval: We do not endorse or validate the content on AllMyFlix. The opinions expressed by creators or users do not necessarily align with our own views.
2. Content Rights: We do not grant any rights concerning the content. Any such rights can only be conferred by the creators.
3. Identity Disclosure: Your content might be seen by individuals who recognize your identity. We are not liable if your identity is revealed through your content. Although we might occasionally offer geofencing or geolocation technology, we do not guarantee its precision or reliability, and you cannot hold us accountable for any reliance on this technology.
4. User-Generated Content: All content is created and provided by users, not by us. We do not select, or alter the content transmitted via AllMyFlix.
5. Following User Advice: You are not required to follow any suggestions, comments, reviews, or instructions from other users. If you choose to do so, it is entirely at your own risk.
6. Earnings Guarantees: We do not promise or assure that creators will earn any specific amount of money from using AllMyFlix.
7. Information Reliability: The materials we provide on AllMyFlix are for general informational purposes only. We do not guarantee their accuracy or that users will achieve any specific outcomes from using them.
8. System Compatibility: We do not guarantee that AllMyFlix will be compatible with all devices and operating systems. You are responsible for configuring your technology to access AllMyFlix and should employ your own virus protection software.
9. Internet and Connection Issues: We are not responsible for the availability of the internet or any errors in your connections, devices, or software related to your use of AllMyFlix.
10. Security Assurance: While we endeavor to ensure AllMyFlix is secure and free from bugs and viruses, we cannot guarantee this and have no control over the content provided by creators.
11. Account Security: We are not liable for lost, stolen, or compromised user accounts, passwords, or email accounts, or any resulting unauthorized activities or transactions.
12. Content Usage by Others: Once your content is posted on AllMyFlix, we cannot control its use by other users or third parties. Deleting your account does not prevent the dissemination of your content that may have been recorded by others prior to the deletion.

In conjunction with the Limitation of Warranties as explained above, you expressly understand and agree that any claim against us shall be limited to the amount you paid, if any, for use of products and/or services. AllMyFlix will not be liable for any direct, indirect, incidental, consequential or exemplary loss or damages which may be incurred by you as a result of using the Service, or as a result of any changes, data loss or corruption, cancellation, loss of access, or downtime to the full extent that applicable limitation of liability laws apply.

Ownership of any Content you post on or through the Service is retained by you, however you hereby grant us a non-exclusive, fully paid and royalty-free, transferable, sub-licensable, worldwide license to use, host, reproduce, modify, adapt, translate, publish, publicly display and/or distribute and create derivative works of your Content. This only refers and applies to content posted via the "Service" as described, and does not refer to information that is provided as part of the registration process, necessary to use the Service. All information provided as part of our registration process is subject to the Service's Privacy Policy available at https://allmyflix.tv/accounts/privacy. This license can be ended by removing your content or deleting your account on the Service.

We do not assume any liability for any content posted by you or any other 3rd party users of the Service that may violate or infringe on any 3rd party copyrights or trademarks.

The Service provides and contains content and materials that are owned or licensed by All My Flix LLC including but not limited to text, graphics, website name, code, images, and logos are the intellectual property of All My Flix LLC and are protected by applicable copyright and trademark law. Any inappropriate use, including but not limited to the reproduction, distribution, display or transmission of any content on this site is strictly prohibited unless specifically authorized by All My Flix LLC.

You agree that we may, at our sole discretion, suspend or terminate your access to all or part of the Service with or without notice and for any reason, including, without limitation, breach of this User Agreement. Any suspected illegal, fraudulent or abusive activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities. Upon suspension or termination, your right to use the Service we provide will immediately cease, and we reserve the right to remove or delete any information that you may have on file with us, including any media, account or login information.

This service is controlled by All My Flix LLC from our offices located in the state of New Mexico, US. It can be accessed by most countries around the world. As each country has laws that may differ from those of New Mexico, by accessing our website, you agree that the statutes and laws of New Mexico, without regard to the conflict of laws and the United Nations Convention on the International Sales of Goods, will apply to all matters relating to the use of this website and the purchase of any products or services through this site.

Furthermore, any action to enforce this User Agreement shall be brought in the federal or state courts located in New Mexico, US. You hereby agree to personal jurisdiction by such courts, and waive any jurisdictional, venue, or inconvenient forum objections to such courts.

UNLESS OTHERWISE EXPRESSED, All My Flix LLC EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
